FresSsco analytical report 2016 - Effective judicial protection in the framework of Directive 2014/54/EU
A free-standing fundamental right expressly recognised as such in Article 47 of the Charter of Fundamental Rights of the European Union, the principle of effective judicial protection has an overarching and pervasive constitutional relevance in guaranteeing Member State’s compliance with EU law.
Ever since the seventies, as is shown in chapter 1 of this report, this principle has been progressively elaborated by an impressive amount of case law of the Court of Justice of the European Union (CJEU) around four basic conceptual pillars.
